National

Consensual sex between same sex couples is unlawful [R1.1].


Article 318 of Penal Code of the Federal Islamic Republic of Comoros17 provides -

"Any indecent assault consummated or attempted over the person of a child of either sex under the age of fifteen years shall be punished with imprisonment from two to five years.

"An indecent assault committed by any ascendant or person with authority over the minor victim over the age of fifteen years will be punished the maximum sentence.

"Without prejudice to more severe penalties provided by the preceding paragraphs or sections 320 and 321 of this code, any person who has committed a shameless act against nature or with a individual of her sex shall be punished by imprisonment of one to five years and a fine of 50 000 to 1 000 000 francs.

"If the act was committed with a minor, the maximum penalty will be always delivered [R1.2].
