CANADA: On 27 July 2016, after a 3-year fight and six proceedings including two in the Federal Court, Immigration and Refugee Board Member Michele Pettinella granted Rolston Ryan from St Kitts and Nevis refugee status, stating unequivocally that St Kitts and Nevis is unwilling to safeguard its LGBT citizens, saying ''The state criminalizes homosexual activity. This is reflective of a state that is homophobic'' [R1.1].

Consensual sex between same-sex male couples is unlawful. Consensual sex between same-sex females couples appears to be lawful [R1.1]


Offences Against the Person Act

Section 56 "The abominable crime of buggery" – up to 10 years imprisonment, with or without hard labour.

Section 57 "Whosoever attempts to commit the said abominable crime, or is guilty of any assault with intent to commit the same, or of any indecent assault upon any male person, is guilty of misdemeanour, and being convicted thereof shall be liable to be imprisoned for any term not exceeding four (4) years with or without hard labour."
