Legislation

The Criminal Code, Section 250 provides -

Sodomy and bestiality

Any person who is guilty of the crime of sodomy or bestiality shall be liable to penal servitude for a term not exceeding 5 years.

Based on the definition of sodomy in the other former British colonies in Africa as Namibia, Swaziland and Zimbabwe which only covers anal intercourse; this is probably the situation for Mauritius as well. [R1.1].


On 18 December 2008, Mauritius was one of the 66 countries that signed the joint UN statement for LGBT human rights however, there has been no indication that decriminalisation of homosexuality is imminent [R1.2].
