Criminal Code 2007 – Section 113

(2) A person who engages in sexual intercourse with another person who is under the age of 16 years is guilty of an offence punishable, on conviction, by imprisonment for 14 years.

In 2005, Norfolk Island created the De Facto Relationships Act 2005, providing for domestic partnerships beginning on 28 February 2006 [L1.1].

The legislation sets out the criteria for a court to determine the eligibility of couples to be recognised as de facto partners, and requires an application to the Supreme Court.

Circumstances of the relationship, which include duration of the relationship, financial aspects, and shared responsibilities, are taken into account.
