In 2004, discrimination in employment based on sexual orientation was made unlawful under the Anti-Discrimination Act [R1.2].

In June 2003, as part of a lengthy battle for the introduction of legislation preventing discrimination against homosexuals and other minority groups, parliament approved a clause in the amended labour code forbidding employers from enquiring about their employees' sexual orientation [R1.1].

The labour code explicitly forbids discrimination on the grounds of gender, race, and physical ability, but did not mention sexual orientation.

The homosexual community says that the new provision is no guarantee of non-discrimination in the workplace.

On 08 February 2015, Slovak conservatives did not turn out anywhere near the 50 percent of voters needed on Saturday to approve a referendum that would have strengthened the country's ban on marriages and child adoptions by same-sex couple. The Statistics Office said that votes counted from 99.9 percent of the central European country's voting districts showed a turnout of just 21.4 percent [R1.4].

On 27 November 2014, President Andrej Kiska announced that the country will hold a referendum on same-sex marriage and adoption on 07 February 2015 [R1.3].

On 04 June 2014, parliament voted 102-18 to amend the constitution to define marriage as a union between man and woman, effectively closing the door to same-sex marriage and stirring protest among rights groups. The amendment required a two-thirds majority in the 150-member parliament [R1.2].

In November 2004, the government of Slovakia said it would not recognise same-sex marriage or civil unions conducted in other European countries. Slovakia's conservative Interior and Justice Ministers being the force behind the move [R1.1].

On 03 September 2014, President Andrej Kiska announced he would not yet call the controversial referendum on the protection of the traditional family and a ban on the adoption of children by same-sex couples, as he will first ask the Constitutional Court to examine the proposed questions:

  1. whether there should be a ban on the adoption of children by same-sex persons;

  2. whether only a union of man and woman can be called marriage;

  3. whether marriage will be given special protection unlike other forms of cohabitation of two persons; and

  4. whether schools should be forbidden from demanding pupils' compulsory attendance of instruction on sexual education and euthanasia [R1.1]
