On 13/14 October 2012, Governor Ric Todd signed the Equality Bill 2012. Subject to Gazettal, under the Bill, consensual sex between same-sex couples is lawful at age sixteen (16) years [R1.2].

Part XI of the Equality Ordinance 2012 provides [L1.1]

Section 84 Homosexual acts in private

(1) In its application to the Turks and Caicos Islands, article 3 of the Caribbean Territories (Criminal Law) Order 2000 has effect subject to the following adjustments –

(a) in paragraph (1), for "eighteen years", substitute "sixteen years"
(b) in paragraph (2), omit sub-paragraph (a) and the word "or" following it;
(c) in paragraph (6) for "eighteen years" substitute "sixteen years".

(2) This section is to be treated as having had effect from 1 January 2001.

On 13/14 October 2012, Governor Ric Todd signed the Equality Bill 2012. Subject to Gazettal, under the Bill, sexual orientation is a protected characteristic and discrimination on that ground in the provision employment and services is unlawful [L1.4], [R1.3].

On 15 October 2012, The Turks and Caicos Islands Constitution Order 2011 (Statutory Instrument 2011 No. 1681) came into effect and included sexual orientation in the fundamental rights and freedoms of the individual (Section 1) and protection from discrimination on that ground (Section 16) [L1.2], [R1.1].

On 01 January 2001, consensual sex between same-sex couples was decriminalised [R1.1].

Previously:

On 13 December 2000, an Order in Council to repeal the sodomy laws was made by Her Majesty at the Privy Council meeting to come into force on 1 January 2001 [R1.2].

In November 2000, the British government was expected to issue an order that would legalize consensual gay sex between adults [R1.3].

In January 1998, the government of British Prime Minister Tony Blair demanded that Britain's five Carribean Dependent Territories legalise gay sex [R1.4].
